Silver Lake Los Angeles|Munson-Montejano Realty

Silver Lake ResivoirSilver Lake Los Angeles is one of my favorite Los Angeles Neighborhoods. I love it’s hip, trendy and culturally diverse energy and its wide variety of shopping, culinary and social experiences.

Some of my personal favorite dining spots include: “Cliff's Edge”, “Gindergrass”, “Silver Lake Wine”, “Madame Matisse”(for breakfast), “Dusty's”, “The Desert Rose” in Los Feliz, “Masa” in Echo Park for great deserts & Chicago style pizza and of course “Two Boots” for their great Louisiana style pizza.

And let’s forget the eclectic night life scene and all of the neighborhood coffee houses such as Intelligentsia for coffee.

Silver Lake ResivoirPart of Silver Lakes charm is its somewhat windy and hilly streets and of course its namesake reservoir, Silver Lake Reservoir which is composed of two basins, with the lower named Silver Lake and the upper named Ivanhoe. The lower body of water was named in 1906 for Water Board Commissioner Herman Silver, and in turn lends its name to the neighborhood. The upper body received its name after the 1819 Sir Walter Scott novel Ivanhoe (source Wikipedia)

As someone who is passionate about architecture, I really appreciate the variety of home types including craftsman, Spanish style and contemporary homes and buildings you will see throughout the Silver Lake-Echo Park and adjacent neighborhoods.

What is a Short Sale? A Short Sale is the sale of a home when the net proceeds do not fully pay off the existing mortgage loan(s) and the Lender is willing to accept a discounted payoff. Why would my lender accept less than what is owed on my mortgage? Lenders are in business to lend money, not to own real estate. They do not want the expense of the foreclosure process and/or the holding and maintaining of the property if it does not sell at foreclosure. The foreclosure process is very expensive and time consuming, so many lenders will agree to what seems a loss on the mortgage when they will actually save money by not completing the foreclosure and holding the property in their portfolio.

If I do a Short Sale, how much will I have to pay to sell my home? In most cases, you will not pay any sales costs if your Lender approves the Short Sale. All commissions, title and escrow fees, and some repair expenses are paid by the Lender, Investor or Mortgage Insurance company, if applicable, as part of the Short Sale approval.


Will my short sale be confidential? We do not market the property as a short sale. We must however note in the MLS in the private agent remarks; this is a short sale.

Can I simply deed my property to someone else and avoid the hassle? Deeding your property to someone without paying off the mortgage loan does not forgive you of the debt, and the property is still encumbered by a lien. Always check with your attorney to verify all the options available to you.

What sort of hardship would my lender consider legitimate? To some extent, that will depend upon the Lender considering your Short Sale request. Below you will find a list of common “hardships” that may be accepted by Mortgage Servicers:

  • Family illness or injury
  • Job relocation
  • Job loss or significant income loss
  • Divorce or split of domestic partners
  • Death of a spouse
  • Adjustment in mortgage payment or unforeseen increase in living expenses
  • Too much debt
  • Military service

I am current on my mortgage, so will my Lender consider a Short Sale? Many lenders now will consider a Short Sale offer on mortgage loans that are not delinquent. Other lenders will not consider a Short Sale offer until the loan is delinquent. We will work with you to put your Short Sale offer together and submit it for approval (remember, there is no charge for this). That is the best way to determine if your Lender will accept a Short Sale offer on a loan that is current.

Do lenders approve all Short Sales? No. That is why it is critical to work with someone, that has extensive experience at getting Short Sales approved and has direct contact with Mortgage Servicers

I have a second mortgage on my property, so can I still do a Short Sale? Yes. We can also work with the Mortgage Servicer or lender that holds the second mortgage, (many times the same Mortgage Servicer holds the 1st and the 2nd loans) to put together a Short Sale transaction. It is very important however, that you let us know if you have a second mortgage, home equity line of credit (HELOC), or any type of lien against your property such as a Home Owners Association lien, tax lien or mechanics lien.

My property is in rough shape and needs work; can I still do a Short Sale? Absolutely, Lenders often take into consideration repair costs, as a factor, when determining whether to approve a Home Short Sale offer.

I am concerned about my credit, so how will a Short Sale affect my credit? The goal is to avoid foreclosure. Consult your attorney to verify how this may affect your credit.

Can I receive cash from a Short Sale? No, short sales are only designed to get you out of your mortgage debt rather than going through the entire foreclosure process. It is not a refinance option and you will be vacating the property, as you would, if you were going through foreclosure. What if my home is not worth what I purchased it for? This is the typical scenario for a short sale, when you can only sale it for less than it is currently worth.


What if I have filed bankruptcy? You will need to check with your Bankruptcy Attorney to verify if you can proceed with a Short Sale.

Avoiding home foreclosure can be stressful. Distraught homeowners facing foreclosure are not alone. Today, 1 out of 7 homeowners is delinquent on their mortgage or in the process of foreclosure. Knowing your home foreclosure alternatives and where you stand can greatly reduce that stress and help you form a game plan that will help you avoid foreclosure..

Let's talk about Home Foreclosure Alternatives, what are the options?

Lender Loan Modifications or Lender Workout | Of course the best course of action for the distressed home owner is to stay in their home and avoid any other alternatives. With that in mind a Lender Loan Modification or Workout should be vigorously pursued. With this as an option your lender may be willing to:

  • Add the missed payments to the existing loan balance.
  • Change the interest rate, including making an adjustable rate into a fixed rate.
  • Extend the number of years you have to repay.

When the lender can work out terms that lower the monthly payment and bring the principle balance closer to today's market value, this is the best choice.

Unfortunately, this is often only a temporary fix and ultimately stretches out the ultimate conclusion of the home owner having to give up their home.

Why is that? Often the new terms are still not enough to justify the homeowner staying in the home. For example: The principle balance is still way above market value or because of financial hardship there is simply not enough income to sustain even the new terms of the loan

So then What?

  • Sell And Bring Cash to Closing- Of course is a ridiculous option for most because their resources have already been drained.
  • Deed in lieu of foreclosure-A Deed in lieu of foreclosure is when the home owner gives up title or deed to the lender to satisfy the loan. However, if the borrower owes more on the home that is owed, it is often unlikely the lender will agree to a Deed in Lieu of foreclosure.
  • Short Sale- A short sale can is often the best solution for home owners who are upside down. In the past, it was rare for a bank or lender to accept a short sale. In the past, it was rare for a bank or lender to accept a short sale. Now, however, due to overwhelming changes in the market, banks and lenders have become much more flexible when it comes to approving short sales.

Recent changes in many corporate policies and the Obama administration have also greatly improved the chances of getting many short sales approved.

To be clear, here is a more technical definition of a short sale: When a seller must sell their home for less than they owe on the property, and the lender that they owe the money to agrees to take less than they originally loaned to the seller, that is a short sale. The "short" of the sale is the difference between what the property can be sold for now minus the loan balance.

Example: Home owner owes $400K on loan for their home, but the home is only worth $300K. The "short" of the sale would be $100K Plus Expenses that the Lender would have to take a loss on.

What qualifies a seller for a short sale?

Here are just a few examples of Hardships that may qualify a seller for a short sale.

  • Loss of Job
  • Becoming disabled
  • Divorce
  • Death of a spouse
